The NLCRPD has two pension plans: the Police Pension Plan for police officers and the Non-Uniform Pension Plan for all other full-time employees. These plans are subject to the requirements of Commonwealth Statutes to comply with public notification and regulatory requirements. In an effort to provide public transparency the NLCRPD is providing both a copy of the guiding statute and the agency public notice of compliance as an attachment to this post. This Act 44 Disclosure form is a static part of the agency web page and is found under the “reports” drop down tab.
What is an Act 44 Disclosure ? Chapter 7-A of Act 44 of 2009 mandates the annual disclosure of certain information by every Contractor that is a party to a professional services contract with one of the pension funds of the Municipality. Act 44 disclosure requirements apply to Contractors who provide professional pension services and receive payment of any kind from the Municipality’s pension fund. It is the Municipality’s responsibility to prepare and send the Disclosure Form to all Contractors requesting their responses.
When the NLCRPD receives the completed forms, the Contractors’ responses are reviewed by the NLCRPD Administration and then approved and accepted by the NLCRPD Commission to determine if there are any conflicts of interest. The NLCRPD files these completed Disclosure Forms with the pension plan documents. Since the NLCRPD maintains a website, it is required by Act 44 that all Disclosure Forms be posted on the website.
