The NLCRPD has issued a new written directive providing all NLCRPD agency members with guidance on requests for police assistance from individuals acting in the capacity of bail recovery agents, bounty hunters or other pseudo bail recovery or fugitive agencies. Police agencies across the nation have been exposed to both risk of civil liability and resultant litigation in connection to events where “apprehensions” were taking place. While the legal authority is ambiguous, and policy, or supervisory requirements for bail recovery agents is often lacking or inconsistent. As such in the best interest of the agency and our community the NLCRPD has adopted the policy position that the NLCRPD will not assist these individuals in any material manner. The NLCRPD is issuing this directive as a proactive step to insulate the community and the NLCRPD agency from actions that may be the basis for undesired outcomes.
The NLCRPD will however vigorously investigate and attempt to locate and serve warrants on wanted individuals with verified warrants consistent with the rules of criminal procedure and provide immediate assistance to any sworn law enforcement officer, deputy sheriff, or state, federal, or local sworn Task Force Members in the apprehension and prosecution of fugitives.
