Right-To-Know Request

Pennsylvania’s Right to Know Law, Act 3 of 2008, as signed by Gov. Edward G. Rendell on February 14, 2008

IMPORTANT NOTICE: Under the Right-to-Know Law, investigative reports (ie. incident reports and police reports) are exempted from the definition of a “public record”, therefore, any such request will be denied.

Criminal history information is not accessible under the Right-to-Know Law, but may be obtained through the submission of a Request for Criminal Record Check, Form SP 4-164, which is available on the Pennsylvania State Police website (www.psp.state.pa.us) all such requests will be referred to the Pennsylvania State Police. The New Holland Police Department does not possess or retain investigative or administrative information for other state or local agencies; therefore, such requests will be denied.

Please note that you must keep the emailed version of this request in order to file an appeal.

Appeals

If your request has been denied, you can file an appeal with the Office of Open Records or Lancaster County District Attorney's Office (see below). There is no fee and you do not need an attorney. All appeals must be made in writing and must be submitted within 15 business days from the mailing date of the NHPD's response or the date that the request was deemed denied. If that timeframe expires before you provide the required information, you lose your right to appeal and may need to file a new RTK request.
