Upon the completion of the extensive Accident Reconstruction Investigation of the fatal accident on February 28, 2019, the Quarryville Borough Police Department has filed a citation for Driving Vehicle at Safe Speed against the driver, Amanda J. Boyd, 29, of Nottingham, PA.  Citation was filed before MDJ Stuart Mylin.

A thorough investigation of the incident that reviewed all factors, circumstances and evidence showed there were multiple factors involved in this tragic collision, to include:

The pedestrian was crossing outside of a crosswalk while wearing light colored pants and a black jacket during the early morning, while it was dark, which blended into the background.  There was glare from the headlights of oncoming traffic.

While our review indicated that there was speeding by the motorist, we, in consultation with the District Attorney’s Office, determined the aforementioned factors also contributed to this tragic accident.

We found no evidence of reckless driving or that Boyd was preoccupied by a cellphone.

Boyd was very cooperative with police, providing us with her phone for review, which allowed us to determine it was not in use at the time of the incident or even prior to it.

The charge filed makes this no less of a tragedy, and we have discussed the findings with the decedent’s family.

In summation, the investigation involved a reconstruction of the collision along with interviews of individuals and reviews of all other relevant reports and evidence.

Original Post of the Fatal Accident:

At approximately 5:57 am, on Thursday, February 28, 2019, Lancaster County-Wide Communications received a call of a person struck.

The location was the 300 block of West Fourth Street, Quarryville, PA.

The Quarryville and Refton Fire Departments, local EMS and the Quarryville Police responded to find a man lying on the side of the roadway. EMS personnel pronounced the man deceased immediately.

Witnesses stated that this man was crossing the street from the convenience store to his truck, which was parked across the street from the store, when he was struck by a vehicle that was traveling northbound in the 300 block of West Fourth Street.

The vehicle was driven by a 28-year-old female from Nottingham, PA, who was on her way to work. The driver did stop and remain on scene and has been fully cooperative with the investigation.

The pedestrian was identified as David Hess, 66-years-old, of the 300 block of Buck Road, Quarryville, PA.

Several police officers, who are members of the Lancaster County Crash Team, also responded to conduct a detailed processing of the accident scene. A member from the Lancaster County Emergency Management Team responded with a drone to capture aerial video of the scene.

A coordinated investigation between the Lancaster County District Attorney’s Office, the Lancaster County Crash Team and the Quarryville Borough Police Department is being conducted.
