The NLCRPD has filed criminal charges against a 25-year-old man currently incarcerated in the Lancaster County Prison on unrelated offenses. TIMOTHY SHAWN KELLEY, formerly of Chinchilla Avenue, in Mount Joy, PA was charged with a single count of tampering with evidence in connection with a drug related death investigation conducted by the NLCRPD on Jul 1, 2017 on Holly Tree Road in Penn Township.
The 04:24 AM dispatch on July 1, reported that a male patient had possibly overdosed at the residence and requested emergency medical services to assist the victim. NLCRPD responding officers located the deceased victim, but did not locate any drugs or paraphernalia related to use of heroin or indicators consistent with overdose investigations.
Follow up investigation by NLCRPD detectives determined that KELLEY was at the residence and was with the victim at the time of the victim’s death. KELLEY is to have had contact with another resident of the home and awakened the resident to report that the victim had overdosed and that KELLEY had to flee prior to the arrival of police, later returning to the home after the departure of police, EMS, and Coroner’s Office investigators from the residence. At this time, KELLEY hid two empty bags which had previously contained heroin, in the victim’s bedroom. NLCRPD patrol officers later recovered these bags from the cooperating house occupants.
When interviewed by Detective Therese Staffer on August 18, 2017 KELLEY admitted to removing two bags of heroin from the hand of the deceased victim and a hypodermic needle and a “bag of weed” – (marijuana) prior to fleeing the home.
Detective T. Stauffer filed one count of tampering with evidence, graded as a misdemeanor of the second degree against the defendant in the office of MDJ 02-2-08 on 08/30/2017.
