LITITZ BOROUGH - The LBPD filed a criminal complaint and affidavit of probable cause against Daniel C. SMITH, age 53, of Ephrata, alleging he committed the crime of Defiant Trespass (grade: M1).
On 10/06/2020 at 8:10 AM, LBPD patrol officers responded to the Bonfield Elementary School, 101 North Oak Street, after SMITH was confronted by a Warwick School District Officer for being on school property. SMITH was initially located near the front entrance and had no reason to be at the school. The School District Officer asked SMITH to leave numerous times, but SMITH refused and attempted to walk past the School District Officer towards the front door of the school. Responding LBPD patrol officers encountered SMITH near the front doors and he was taken into custody. Following booking at the LBPD, SMITH was transported to MDJ Tobin's Office where he was afforded an immediate preliminary arraignment. SMITH was subsequently committed to Lancaster County Prison after failing to post a $25,000 secured bail related to these charges. Additionally, SMITH was committed on a bail violation connected to an unrelated charge. A preliminary hearing has been scheduled.
It is important to note that no students, staff or other persons were in danger at any time.
SMITH is presumed innocent.
