On Sunday 30 April 2017 at approximately 1717 hrs. Off. Caple and Off. Herr stopped to speak with a group of males on the 500 blk. Penn Ave. A male, later identified as Rolando N. Rivera, bladed his body away from Officers and covered his right hip with his jacket. That movement partially exposed that Rivera had a handgun in the waistband of his pants.
When Officers made contact with Rivera, he was found to be in possession of a Smith & Wesson 9mm semi-automatic handgun. When speaking with Officers Off. Caple noticed that Rivera's speech was slurred, his eyes were bloodshot and he did not appear to be completely aware of his surroundings. Rivera told Officers that he had smoked marijuana prior to their arrival. Rivera is 19 years of age and is not elligible to obtain a permit to carry a firearm in concealed fashion.
Off. Caple placed Rivera under arrest. A Criminal Complaint was filed against Rivera before MDJ Wilwerth. Rivera was charged with Firearms Not To Be Carried Without a License (F3) and Public Drunkeness. Rivera was later arraigned and committed to LCP in lieu of $100,000 bail.
All persons accused of a crime are presumed innocent unless proven guilty in court.
